In the criminal justice system, sexually based offenses

are considered especially heinous.

In New York City,

the dedicated detectives

who investigate these vicious felonies are members of an elite squad

known as the Special Victims Unit.

These are their stories.

[dramatic music]

Did Detective Tutuola kidnap Mr. Marks or not?

The arresting officer traveled to another sovereign country, invaded its sovereign borders, and grabbed up a resident in violation of its sovereign laws.

Counsel failed to mention that the resident in question is a serial r*pist.

Nobody knows what he is until ordinary citizens sitting in that box tell us.

Mr. Dworkin's heartfelt argument notwithstanding, the Ker-Frisbie line of cases holds that the manner in which a person is brought into a jurisdiction is irrelevant as to whether the court has the power to try him.

I see your Ker-Frisbie line of cases, and raise you one "US v. Toscanino," which held that the court should divest itself of jurisdiction following an illegal capture on foreign soil.

If the defendant was tortured before being brought home.

As to that, I'll hear testimony tomorrow.

I was rougher picking up token suckers when I was back in uniform.

So I went down there, and I found him.

And I put him in the back of a van until I was able to convince the local cops that I was who I was and he was who he was.

If, in the course of your job, you found a dog sitting in a car on a degree day, what would you do?

Although I don't approve of Detective Tutuola's tactics, I don't think they've reached the level of t*rture as defined by the Second Circuit in Toscanino.

So therefore, the trial of Mr. Marks will proceed forthwith unless anyone has any more motions.

Mr. Formosa is from the Cuba Permanent Mission at the U.N.

Your Honor, on behalf of the Cuban government, I object to agents of your government violating our borders and our laws.
