Either way, I suggest you sign this deal.

And I meant it, but I also knew, if push came to shove, I'd do what I had to to get Mike out.

And when I pushed him away and told him to stop, he got angry, said I'd been leading him on.

He started forcing himself on me.

[TENSE MUSIC] Then what happened?

I ran out there as fast as I could, went to my room, and threw up.

I can't have him in my company, Louis.

Which is why you're going to go to the board right now and tell them what that m*therf*cker did.

Because it happened 15 years ago.

And in case you haven't noticed, women who come forward get put through a meat grinder.

Malik's coming after him for conspiring with me two years ago.

This is about Mike.

Harvey, Andy Malik doesn't care about Sean Cahill.

If he's doing this, he's coming after you.

They're using attorney-client privilege to get away with the conspiracy they engaged in in the first place.

Not engaged in, are accused of engaging in.

And how is it any different than a joint defense agreement?

I'll tell you how it's different: you're setting this thing up for a mistrial.

Because when I win, that's exactly what he'll ask for.

Your Honor, I will resign as Mr.

Cahill's attorney right now if he hands this case over to someone else, but he won't, because no one else will touch it.

I'm not walking away from a case that I've been building for eight months.

A legitimate reason to stop a merger from happening.

It is, and she used to work for the man that runs the other company, and let's just say they are like oil and water.

If that's true, why does he even want to merge with her?

Because my sister's a brilliant businesswoman and the easiest way for a scumbag like that to make money is to leech off of her success.

- Good, because a lawsuit'll gum up the works, but I don't see any grounds.

Her board just got proposed to, and no one's walking in with a bigger diamond.

Louis, when it comes to diamonds, bigger isn't always better.

Therefore, if we want to t*nk this deal, we just have to figure out what it is.

According to Andrew Malik, you should have plenty of time.

I'm here to tell you this merger is not happening.

What this is about is two companies that have synergy utilizing their respective resources.

This is a vendetta, and when it goes south, it's gonna look as bad for Malik's superiors as it does for him.

I mean the Sutter case was in the public record and so was Mike's release.

So why is Malik bringing it up years later?

I don't know, but the person that can shed light on that very question is Kevin Miller.

Harvey.

I can't say I'm surprised to see you.

I may not be surprising you, Kevin, but you sure as hell surprised me.

Look, if you wanna call me an assh*le, - you might as well get to it.

I'm here to find out what the hell are you doing playing ball with Andy Malik.

Harvey, he said if he convicted Cahill and we didn't cooperate, he'd void the deal we made, Jill would go to prison, and I'd go with her.

And let me guess: he gave you immunity in exchange for talking.

And he made it contingent on me not warning you about it.

That's why I didn't give Malik everything.

He has my affidavit, but he doesn't have proof.

I didn't tell him it exists and I'm not going to.

But if you're here to get me to change my story, that's as far as my owing you goes.

Why didn't Sutter go to Malik until now?

That's the thing.

I don't know who went to Malik, but it wasn't him.

How can you know that?

Because Sutter d*ed eight months ago.

[SOFT MUSIC] Here's what I don't get: Malik couldn't know any of this without Sutter, which means Sutter must have reached out to him before he d*ed.

But that was close to a year ago, and there's no reason Malik would sit on this for that long.

Then he must have found out from someone else, because there's no record of any conversation between Malik and Sutter ever.

That doesn't mean it didn't happen.

It means Malik's hiding it.

Harvey, why would he expose himself like that?

The case could get tossed on a technicality.

He's played fast and loose before.

Maybe he's doing it again.

He might be, but not about this.

The warrant that Malik used to go after Kevin Miller had to show probable cause.

It turns out it was a deathbed confession by Sutter to an informant whose name was redacted.

Under what grounds?

To protect him against retribution in prison, which is what I wanted to show you, because the name of the prison is gonna ring a bell.

Holy sh*t.

Pat me on the back later, Harvey.

It's what needed to be done.

Well, what needs to be done right now is for me to go see an old friend.

What the hell did you do?

I came to you to find me a way out of this, and the next thing I know, my own board triggered my buyout clause.

Because when I win, whatever deal you cut with Malik is gone.

Then again, if you said you made this whole story up, Cahill might just cut your sentence in half.

So you need to ask yourself who's coming out on top: Malik or me?

The real question is, which one of you two is gonna figure that out first?
