all right you may step down sir Troy now just a minute Lieutenant

there's something I want to add before it gets lost in the shuffle we're not just dealing with a statistic

the boy who was struck down by Adam Troy's blatant criminal irresponsibility was my son's best friend Mr Forsyth I

don't think this is relevant but it is Sir Doug tell them what a fine boy Ted was just a

some of you may have been misled by my opening remarks but this investigation would be held with less formality than a

court trial perhaps I had best fully restate the nature of these proceedings

the United States Coast Guard is authorized to conduct an investigation of any casualty at Sea involving a

United States vessel this investigation to be held at the nearest Coast Guard Station having an

officer qualified for such an investigation all parties in interest have a statutory right to be present to

be represented by Council to cross-examine and to have called in Witnesses in their own behalf all

witnesses will be under oath subject to federal laws penalties of perjury under 18 U.S code 1001 the

present investigation is intended to determine the cause of the death of Theodore Costa on board the Schooner

Tiki the night of August 9 this year and to determine to what extent if any

said death was the result of incompetence misconduct or willful violation of the law on the part of

Captain Adam Troy at the conclusion of this investigation

my report will be sent to the district Commander United States Attorney at Honolulu

you should all understand that my recommendations will carry considerable weight

and that the charges against Captain Troy are of such nature that he is subject to the loss of his master's

papers and possible imprisonment are there any questions

Captain Troy I would like to clarify a few things right after Ted coston's

death did you question the young people on board as to what had happened no I didn't they were pretty badly shaken and

went coherent so I sent them below then the radioed this Coast Guard Station and the radio at Mr Forsyth

Tahiti I told him that there had been a fatal accident on board Forsyth arrived in a seaplane in an hour

he took his son two girls back to Tahiti it wasn't until we docked in papayera the next day that I heard anything about

few parts of papaya I've never seen before from hotel to floppos and bar to Jail the answer was the same no Delaney

the only place left to look was the harbor I started with the working ships the inter-island Traders but Delaney hadn't

been seen around there in a month now I began to worry papayetti was too small a town and too small an island for

someone just to vanish this way the story was the same all the way along the K where the pleasure boats tied up

not a trace of Ed Delaney it was well into the afternoon before I

gave up and faced the fact that one of two things had to have happened either Seaman Ed Delaney had already

shipped out on another vessel or Seaman at Delaney had been bought off was deliberately hiding out

whichever it was my best witness was gone

well that only left Doug Forsyth Jan Lafayette or Phyllis Willoughby to tell the truth

of the three I decided I had the best chance with Phyllis Willoughby she lived with her father the plantation

manages Cottage out on the Foreside place
