Now the cost of the g*ns is not important, Lewis.

These th*gs didn't knock over a deserted dime store

in the middle of the night with a claw hammer.

'They did it in broad daylight and they attacked'

the United States marine corps vehicle.

And if we let 'em get away with it

then they set an example

that makes any federal installation a target.

[knocking on door]

Yes?

Oh, come on in, Rhodes.

Did you get a hold of the SAC, San Diego?

No, he's at the naval hospital.

One of the men was still alive when the highway patrol

found the weapons carrier.

So I left word for them to call you here.

That's Cullinan, isn't it?

Mm-hmm.

Well, he's a good man.

But I want you on the scene too, Lewis.

[intercom buzzing]

Both of you. Ward.

[female #1] 'San Diego calling Mr. Erskine.'

This is Erskine.

How are you, inspector? It's Cullinan.

Oh, I hear you have a witness to that hijacking, Ted.

Yes, sir, the guard on the weapons carrier.

The, uh, military authorities haven't been able to come up

with any suspects but, uh, the guard remained conscious

long enough to give the ambulance driver

description of the truck that stopped him.

It was a grey pickup, no markings.

He also heard one of the unsub say, "They're both dead, babe."

I've alerted the border guards.

Tell me, is Steve Coleman

still the San Diego police intelligence?

Yes, sir.

Well, my partner and I are coming out tomorrow.

Set up an appointment with him, will you?

Right. See you then.

If you've decided to go

hadn't you better start making arrangements?

Yeah, well, let me put it this way.

We don't need more agents to smash the bad guys

all we need are a couple a of good script writers.

You know I never knew what a dangerous business I was in.

Read it, it gets, uh, pretty exotic

around the third paragraph.

"Since our last correspondence

"we are now very happy to say that we're able to offer you

About $60,000 a year worth of corporation law.

That sounds tempting.

- Inspector Erskine? - Yes.

I'm Bill Converse, San Diego field officer.

How are you? This is Jim Rhodes.

- How are you? - How do you do?

The SAC wants to know if you wouldn't mind

taking a little ride before checking into your hotel?

Oh, is this part of the regular tour?

Not exactly. The highway patrol just found a grey pickup.

[instrumental music]

Inspector, good to see you again.

Steve. My partner, Jim Rhodes.

- How do you do? - Gentleman.

- Ted Cullinan. - How do you do?

Oh, no rest for the weary, huh?

Just thought you'd better have a look.

Yeah.

Passenger car met him here.

Yes.

We've already taken the shoe impressions

now we have to get a cast of the treads.

The, uh, Mexican border is about 18 miles due south.

Now apparently, they decided to transfer

the cases and the g*ns.

Why?

Why didn't they just keep going?

As far as they knew, both the marines were dead.

There was no description of the truck.

I don't know, perhaps they were just being cautious.

Then why abandon it so close to the highway?

That's a point.

Any, uh, "Babe's" in your nickname file?

Steve, do you have the syndicate here?

No, nothing much organised. At least not yet.

Now the word's out that the syndicate

is in a dealing mood.

That is, if they can find anybody to deal with.

And someone strong enough to give the franchise to.

And strong enough to hold it.

And strong enough to knock over a government truck

'and pick up two dozen AR-18's to the same time.'

This AR-18, Lew, what's it like?

Light, dependable, 22 caliber, fires 1200 rounds a minute.

Ideal weapon for an attack force.

Or mob.

We could have a Little Vietnam on our hands here

if what you say is true.

And when the doc woke me up

Well, you get some good weeks with the hacks, some bad ones.

he's got empty pockets and he's got a big mouth.

- So you belted him. - 'That's right, I belted him.'

So a trained boxer hits someone, it's a felony.

So now they're looking to take my license away

and send me to jail, that's a great beef.

You could make it easier on yourself

if you are willing to co-operate.

Well, what do you guys got to do with the local rap?

Not a thing.

The State hopes to pick up a m*rder charge

off our investigation.

You hear people talk.

I've been on a lot of things but I've never been on

a police payroll.

I can't turn in some poor loser for a lousy buck.

This particular poor loser

k*lled a 20-year-old corporal

'and chopped up a lieutenant with a wife and two kids!'

Now if those g*ns are in San Diego

what do you think they're gonna be used for, party favors?

Well, how do I know?

Nothing goes away just because you close your eyes

and stop your ears up.

It's here, and it'll get worse

if the syndicate moves in.

when she walks down the street alone at night?

And who's your kid gonna run to when the gangs

move in with the needles and the g*ns?

and then spin a cocoon

I talked to the office. No word from Metro.

So I'll call Coleman this mornin'

see if he can come up with anybody else.

It's too bad, Frankie might have helped us.

Well, man has problems.

You really think it's that simple?

I think when you ask a man to re-examine his entire life

you pose some of the toughest questions

he'll ever have to face.

Lew, have you thought anymore about that offer?

Could anything ever make you leave the bureau?

What would you say if I told you I was seriously considering it?

Oh, I'd be surprised.

But I'd say it was Lew Erskine's business.

I'm not sure it's not Barbara's business too.

Sixty thousand a year. That's a lot of money.

Never able to put anything aside before.

And sixty thousand would only be the start.

Full partnership in two years.

face some simple decisions

and who's gonna leave the tip.

The Mexican police found those g*n cases

in an old sedan down in Baja.

'No prints. Flying the cases back for analysis.'

You still think the machine g*ns are in San Diego, Lew?

[intercom buzzing]

Cullinan.

Yeah, he's here.

Frankie Metro.

Yes, Frank.

Sure, where do we meet?

Right.

- We're in business. - You must have gotten through.

Who knows? We've had what, an hour?

Not much against 28 years.

So I don't know what it's worth, but if the g*ns

are in San Diego or coming to San Diego

the Murtaugh brothers might have something to do with it.

Murtaugh?

Yeah, well, they're kinda big in my neighborhood.

Women, dope, a few books and they're ambitious.

They know a few of the boys back East.

Show 'em around when they're in town.

Well, anyway, I took a fare out to their motel

a pretty Spanish girl wanted to see Mike.

She was in the office talking to Jess for a few minutes.

When she came out, she was all confused.

Seems Jess had told her Mike was running

the bulls down in Tijuana.

You lost me.

Well, I thought maybe these bulls

might be wearing some uniforms.

And Mike could have been planning

something for 'em to find.

Like a pickup truck, a sedan

a couple of g*n cases?

I'd like to take a look at this motel.

[dogs barking]

[instrumental music]

[Lewis] Any chance of getting a man in one of those cabins?

Well, the "No vacancy" sign is on 24 hours a day.

They use the cabins for someone who's a little hot.

Cut a little heroin in the office.

Every so often, the narcotic squad hits it.

By the time they get over the fence and pass the dogs

they usually flush it down the drain.

Alright, we'll make arrangements

for you to be transferred to this area

and you'll get any calls from the motel.

Just keep your ears open.

Pretty quiet here, except for those dogs.

Yeah.

Sometimes the whole south side is like that.

As if we all lived on one long street.

Sometimes, I think about weddings and parties..

...dancing.

And other times it's so quiet

as if we were all holding our breaths

afraid to make the first sound.

Because if you do, somebody'll come around and quiet you.

[dogs barking]

[Lewis] '"Arrested 1955, as*ault with a deadly weapon.'

"Case dismissed.

"Arrested, 1957, possession and sale of heroin.

"Sentenced, San Quentin.

"Parole, 1959.

Arrested, 1959, suspicion of m*rder."

Nice fellow, Michael Murtaugh.

Nothing since 1959.

And nothing much in the way of convictions before.

The last time brother Jess went to jail was in '55.

They've gotten sophisticated.

Hmm.

Either of these men have a nickname?

Yeah, Jess is the old wolf.

Mike, uh

they sometimes called him..

...babe.

[dramatic music]

- Mike. - Hello, Jessy.

- How'd it go? - Beautiful.

How many girls did you buy bathing suits for this trip?

So help me, I lost count.

It's a buck thirty, Mike.

Here, keep the change.

You remember, uh, Frankie Metro, don't you?

Sure, how're things been going for you, champ?

Good. Good.

Come on in, I'll show you the armory.

[Michael] 'Alright.'

[engine starts]

Lieutenant indicated he recognized Michael Murtaugh.

Lieutenant, is this one of the men

who attacked your vehicle?

[coughs] Yes.

Thank you, sir. Good luck.

[Lewis] 'Okay, Jim, pick you up in, uh, 45 minutes?'

'Bye.'

'They only allowed Rhodes a few questions'

but Richardson said he recognized Mike.

He's asleep now. Better keep a man there day and night.

Well, that'll make Capt. Coleman happy.

He can cross off John Doe from one of the m*rder warrants

and write in "Michael Murtaugh."

[intercom buzzing]

Cullinan. Yes, he's here.

Hello. Yes, Frank.

Mike's back from running the bulls.

Jess sent me down to the bus station to pick him up.

That means whatever he drove down there he left.

What about the g*ns?

Well, I drove Mike up to the motel

and as I was turning the cab around

I heard Jess say

"Come on up, I'll show you the armory."

Good, that seems to be what we want.

Listen, how do you figure on getting past those dogs?

We'll get some knockout pellets from the zoo.

Uh...I'm gonna leave town. Okay?

[Lewis] 'Where'll you be?'

Monterey. I got an uncle up there giving me a place

on his fishing boat.

[Lewis] 'Good luck, Frank. Keep in touch.'

Thanks.

Listen, uh, if I helped you, I'm, I'm not sorry.

I thought I would be. But I'm not.

- Hi, Mike. - Hi, champ.

Look like you saw a ghost.

[intense music]

I put the kitchen things in a box

if you wanna take it out to the car.

As soon as I finish here.

I, I called my mother and I told her

we were going away for a while.

You didn't tell her where?

No. You said nobody, so I guess that means nobody.

It was hard.

She's worried about the baby coming so soon.

Honey, well, there's-there are hospitals in Monterey.

- She loves me, Frank. - She loves you?

She's a little sorry you threw your life away

on an ex-boxer with frost on his brain.

Frank, does our going away have anything to do

with you hitting that customer?

Honey, I beat that rap.

[sighs] Then I don't understand.

Well, don't try to understand!

Honey, I'm sorry. I didn't mean to yell at you that way.

Look, that charge is gonna be dropped because I-I gave the FBI

and the State what they wanted.

I turned a couple of people for them.

Why do they want the people?

Well, they k*lled a marine.

Is the FBI gonna pay you?

No. No, honey, I wouldn't take any money.

But then you did the right thing, didn't you?

Maybe.

[chuckles] Then why-why are we running away?

Well...because it's probably safer.

I don't know.

I just don't know.

I just hope to God I'm not putting you into any danger.

'We have warrants for your arrest.'

'I order you to come out with your hands above your heads.'

[g*nshots]

Forget the tear gas, we're too far away.

Never be able to plant it where you want it.

Go with the bulldozer.

We'll give you a covering volley

but stay behind that shield until it's over

FBI, get up against that wall.

Over against the wall.

Feet apart.

- Now, let's get 'em outta here. - Yeah.

Like I say, we were approached by a man

who said he has some obsolete Mexican police g*ns.

I sent Mike down to look at them

and then we smuggled them across the border.

Are you trying to tell me

you thought they were obsolete police g*ns?

Well, they looked obsolete to me.

Who's your contact with the syndicate?

What's a syndicate?

Suppose I told you that Lt. Richardson

positively identified your brother

as one of the men who wounded him

and k*lled Cpl. Eaton.

Well, I'd say a badly wounded man

made an understandable mistake.

What does my brother say?

Honest, I wasn't sure you were really FBI agents

until I saw this building.

[sighs]

Well, the US commission will hold the preliminary hearing

on the federal charges and tomorrow Judge Leverette

will arraign them for receiving possession of stolen property.

Won't the m*rder charges take precedence?

Right, the US attorney will ask the judge

to take the federal case off calendar.

Coleman has Mike in the county jail.

What did Mike have to say?

He couldn't believe we were really FBI men.

He thought it was a pose like, uh, quote

"The St. Valentine's Day m*ssacre", unquote.

[Rhodes] 'Yeah, well, he'll think he's been in a m*ssacre'

'when that m*rder rap hits him.'

I wouldn't count on it.

Got some bad news.

What's that?

Richardson died five minutes ago.

He never regained consciousness after Jim left.

So, the State has no physical evidence and no witnesses.

Well, Richardson identified the photo.

That's good enough for a warrant.

We'll never get a conviction with the only eye witness

under the ground.

The federal charges stick or they're home free.

[dramatic music]

US versus Jess and Michael Murtaugh.

It, uh, it was my understanding that at this time

there would be motion to postpone the hearing

'so that the defendant, Michael Murtaugh'

'could be arraigned on a more serious state charge.'

Your Honor, we've been advised that the district attorney

is not prepared to arraign the defendants at this time.

The government requests a five day postponement

until the district attorney has decided on a course of action.

Your Honor, defense strenuously objects.

Bail has already been posted on federal charges

and to hold these men in jail while county authorities

shift about for some means of assuring up

a collapsing m*rder charge

seems an unreasonable harassment.

The government's motion is denied.

'Mr. Cline, you may begin to offer testimony.'

Thank you, Your Honor.

The government calls Lewis Erskine.

Inspector Erskine, would you tell us

how long you've been employed by the FBI?

We will stipulate that Inspector Erskine

is a qualified law enforcement officer.

Thank you.

Inspector Erskine..

On the night of March 24, 1965

did you and company with other federal officers

and local police, assemble outside of a motel

located at 1315 Sierra Vista in San Diego county?

Yes, sir.

Did you have a search warrant?

Yes, sir.

Your Honor, the defense objects to the inspector giving us

any information about the raid until we have established

just why he and this army array were assembled.

Inspector..

...what did the search warrant

authorize you to look for?

Two dozen AR-18 sub-machine g*ns.

And what caused you to believe the g*ns were on those premises?

I, uh, obtained the information

from a reliable source, Your Honor.

Your honor..

...a long list of decisions is established

to the right of the defendant.

To be informed of the identity of his accusers

at any stage in the proceedings against him.

Mr. Barker, is it your intention to ask for a dismissal

of the charges if such information

is not in the record?

It is.

Mr. Cline?

Mr. Erskine, do you personally know who it was?

Yes, sir, I do.

Inspector, the, uh, the propose for the identification

is to make it possible to bring this man into the court room.

Examine him as to motive and reliability.

I understand that, Your Honor

but, um, I'm under an obligation

not to reveal my source.

This hearing is recessed until Monday, the 29th, at 10 a.m.

All concerned parties will return at that time.

The witness is temporarily excused.

Your honor, I strongly object.

Mr. Barker, I scheduled this hearing in the belief

'that it would be brief.'

'Quite obviously, it is not going to be.'

The general will have to go back with the marshals.

Till the warrant's recalled.

You should be on the streets in a couple of hours.

Very good days work, counsellor.

Beginning to think you're worth all that money.

[instrumental music]

Looks 'like it's all downhill for them.

Yeah, unless they come up with the name of the rat.

Even so. Maybe we can come up with it first.

What wall did this one crawl out of?

Maybe not a wall, Jessy, maybe a taxi cab.

Hmm?

Remember the other day when I came home

when Frankie Metro picked me up at the station?

So?

Well, I saw him again later down on Mission Street

in a phone booth.

Saw me, he darn near jumped out of his skin.

Hmm.

That's worth looking into.

Um, better check what the champ's been doing

with his time lately.

You know where he lives?

No, but I know how we can find out.

[instrumental music]

You saw what we're up against, inspector.

Judge Leverett gave us a break today, can't do it twice.

I told Frankie he was through.

He didn't wanna give us information in the first place.

He risked his life and he wouldn't take a dime for it.

Well, the choice isn't mine.

But if he isn't persuaded to appear

and be available for testimony

Leverett will have to dismiss the federal charges.

The federal charges are all we have left now.

You said it yourself, inspector.

If the Murtaugh's can get away

with thumbing their noses at the federal government

the syndicate will have the strong men they need here.

There'll be more hijacking

more g*ng wars and more blood baths.

Suppose he does testify and you still fail to convict.

The Murtaugh brothers walk out and couple of weeks later

or couple of months, couple of years

they decide they'll get around to my informant.

No, no, if he decides to testify

I promise you, we'll convict.

'Give me the chance.'

Any idea where Frank is, Lew?

Yes, he's out of town in the home of an uncle.

I can't tell you where, but I made sure

the local police would watch the house.

Well, there's nothing to tie up Metro with us.

Isn't there?

I'll give you odds the Murtaugh brothers

have a mental list of everyone they've seen or talked to

since they walked away from that weapons carrier.

And Frank Metro's name is on that list.

As the man said..

"It's a dead end street."

[instrumental music]

Hey, Frank!

Well, if..

- You got a minute? - Hi.

Sure.

I, uh, read about that lieutenant dying, I'm sorry.

Yeah.

Yeah, among other things he was our one witness

to the Eaton k*lling.

Well, you'll get 'em on the g*ns.

And we're not sure about that either.

I don't understand.

g*ns were there. They shot it out with you.

Frank, yesterday in court

the defense demanded I give them

the name of the informant.

And you told 'em?

No, no, the judge recessed.

Look, Mr. Erskine, what do you want? What are you doing here?

We can't convict the Murtaugh's unless you're identified

and available for testimony.

Now, you understand I'm not putting

any kind of pressure on you.

Oh, wait a minute, Mr. Erskine.

Are you, uh... are you absolutely sure

that the case will blow without my testimony?

No question about it.

Well...look, I..

I wanna do the right thing but I've got a responsibility

on my wife and..

Well, I gotta make sure that she goes along with it.

Alright, I'll drive you to your uncle's.

She's not there. She's at the hospital. The baby came.

Congratulations.

Are the Monterrey police covering the hospital?

No, no, they wanted to but I insisted

they forget about it.

I mean, who'd be crazy enough to hurt anybody in the hospital?

Let's get over there.

[engine revving]

He's got a lot of hair, huh?

You think we ought to call a barber, Mrs. Metro?

[chuckles]

I guess it could wait until I get him home.

I better take him back to the nursery.

I'll bring him back again tonight.

And your husband can get a good look.

- You have some visitors. - Oh.

It-it must be my husband's cousins.

[dramatic music]

That's a nice looking boy you got, Mrs. Metro.

I'll tell you what..

...why don't you just keep your mouth shut?

Now, we're gonna get outta here, Mrs. Metro.

We're gonna take a little trip around the peninsula.

So be careful what you say.

I-I don't know you--
